Commissary Court

edit

By John Simpson •

A Scottish ecclesiastical court exercising delegated jurisdiction, chiefly over probate and succession. Commissary Courts administered testamentary business until 1823, when this jurisdiction was transferred largely to the sheriff courts. The term is therefore chiefly encountered in Scottish legal records before the nineteenth-century reform of the courts.
